The Chairperson: Disciplinary and Incapacity Enquiries is expected to independently chair disciplinary and incapacity in a fair, impartial, and procedurally compliant manner, ensuring consistency of outcomes and adherence to applicable labour legislation and Massmart policies. The role is also required to safeguard organisational justice, mitigates legal & reputational risk, reduces financial exposure arising from prolonged suspension, and strengthens confidence in our Employee Relations processes.

Responsibilities:

Independent Chairing of Disciplinary and Incapacity Enquiries

  • Chair disciplinary and incapacity enquiries independently, impartially and professionally.
  • Conduct enquiries in line with Massmart policies, guidelines, and applicable labour legislation.
  • Ensure no prior involvement in investigation or case preparation for matters being chaired.
  • Explain enquiry procedures clearly to all parties.
  • Manage proceedings efficiently to minimise delays and unnecessary postponements.
  • Evaluate evidence, mitigation and aggravation objectively.
  • Deliver clear, reasoned and defensible written findings and sanctions.
  • Ensure accurate record keeping and documentation of proceedings and outcomes.

Governance, Risk and Procedural Integrity

  • Ensure adherence to substantive and procedural fairness principles.
  • Identify procedural gaps, inconsistencies, or systemic risks emerging from hearings.
  • Analyse trends relating to misconduct, sanction consistency and escalation patterns.
  • Provide governance insights and risk observations to the VP: Assistant General Counsel Employment Law and Employee Relations.
  • Contribute to strengthening disciplinary frameworks and controls based on case learnings.
  • Support mitigation of legal and reputational risk through high-quality decision-making.

Stakeholder Management and Collaboration

  • Maintain structured coordination with ER Case Management, Legal, and Ethics teams to ensure effective scheduling and case flow.
  • Collaborate with Employee Relations stakeholders on process improvements while maintaining independence in adjudication.
  • Escalate systemic or material governance risks to the VP: Assistant General Counsel Employment Law and Employee Relations where required.
  • Provide post-enquiry feedback to relevant stakeholders to improve procedural compliance and leadership capability.
  • Provide alignment support between disciplinary processes and broader Associate Relations and ER frameworks as and when required.

Timeliness, Efficiency and Cost Management

  • Drive improved case turnaround times to reduce average disciplinary case cycle duration.
  • Contribute to reduction of suspension-related financial exposure.
  • Prioritise high-risk matters (e.g., sexual harassment, ethics violations, etc.) to mitigate organisational risk.
  • Balance procedural thoroughness with operational urgency.
  • Identify structural inefficiencies in case preparation and escalate improvement recommendations.

Capability Building and Knowledge Sharing

  • Conduct training for leaders on chairing and initiating disciplinary and incapacity enquiries.
  • Share lessons learned from hearings to improve consistency and governance.
  • Contribute to continuous improvement of disciplinary processes across Massmart.

Requirements:

Professional Qualifications:

  • LLB or Honours degree / Post graduate Diploma in Law or Labour Relations related qualification.

Experience:

  • 8+ years’ experience in employee relations/labour relations of which 3 years must have been chairing complex and high-risk disciplinary matters within highly unionised, large or multi-site or retail operational environments.
  • Experience in CCMA/Labour Court environments required.

Skills:

  • Advanced knowledge of labour legislation (LRA, BCEA, EE Act)
